Educator Resources – Terms of Use

The Educator Resources is the property of the Society for Science (“Society”). By using the Educator Resources, you agree to be bound by these Terms of Use for using the Educator Resources.

Ownership of Copyrights, Trademarks and Other Intellectual Property

The entire contents of the Educator Resources, including the text, graphics, images, logos, button icons, HTML code, and other “material” are copyrighted by Society under the copyright laws of the United States. You agree not to remove or obscure copyright notices appearing in the Educator Resources. Society grants no copyright or ownership interests to you for any of the material and proprietary information referred to herein belonging to Society. Permission to use the Educator Resources content for purposes other than those permitted by these Terms of Use may be granted in special circumstances on a case-by-case basis. Please direct any request to otherwise use content to Society at SNHS@societyforscience.org.

Prohibited Uses of the Educator Resources and Society logos

You agree not to reproduce, distribute, transmit (via print, fax, electronic, or other means), modify, alter, or create derivative works of the contents of the Educator Resources, except for use in your classroom or for sharing with other educators in the Science News in High Schools program, without prior written permission from Society.

You agree that the Educator Resources are for educational use only and may not be sold to third parties without prior written authorization from Society.

You agree not to use the Educator Resources, the name of Society, or its logos for any promotional or commercial purpose or any other purpose without the prior written consent of Society.

Intended Audience

The Educator Resources is intended for use by persons 18 years or older.

Waiver of Liability

IN NO EVENT SHALL SOCIETY OR ANY THIRD PARTIES MENTIONED IN THE EDUCATOR RESOURCES BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE EDUCATOR RESOURCES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SOCIETY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

No Warranties

ACTIVITIES FROM THE EDUCATOR RESOURCES ARE DESIGNED TO BE CONDUCTED BY STUDENTS IN GRADES 9 AND HIGHER, AS INDICATED, AND SHOULD NOT BE CONDUCTED WITHOUT ADULT SUPERVISION. SOCIETY MAKES NO WARRANTY OF ANY KIND WITH REGARDS TO THE ACTIVITIES AND OTHER CONTENT FROM THE EDUCATOR RESOURCES, AND SOCIETY SHALL NOT BE LIABLE FOR ANY DAMAGE, INJURY, OR DEATH THAT ARISES FROM THE CONDUCTING OF THE ACTIVITIES IN THE EDUCATOR RESOURCES, INCLUDING ANY DIRECT, INDIRECT, GENERAL, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THE INDIVIDUAL CONDUCTING/LEADING ANY ACTIVITY FROM THE EDUCATOR RESOURCES DOES SO AT HIS/HER OWN RISK, AND HE/SHE ASSUMES ALL LIABILITY THAT ARISES FROM THE CONDUCTING OF THE ACTIVITIES FROM THE EDUCATOR RESOURCES.

THE CONTENT OF THE EDUCATOR RESOURCES MAY CONTAIN INACCURACIES OR TYPOGRAPHICAL ERRORS. SOCIETY MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE EDUCATOR RESOURCES.

THE EDUCATOR RESOURCES ARE PROVIDED ON AN “AS IS” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. SOCIETY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF COPYRIGHT TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity

You agree to defend, indemnify, and hold harmless Society, its officers, directors, employees, and agents, from and against any claims, actions, or demands, including without limitation reasonable legal fees, resulting from your use of the Educator Resources or your breach of these Terms of Use.

Governing Law

These Terms of Use are governed by laws of the District of Columbia. Jurisdiction for any claims arising under these Terms of Use shall lie exclusively with the state or federal courts within the District of Columbia. If any provisions of these Terms of Use are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term.
